Real property practice continues to evolve, through changing government programs, tax implications, regulatory requirements, and day-to-day conveyancing challenges. This Real Property Refresher & Updates CLE brings together experienced practitioners and government and financial representatives to provide timely, practical guidance for Island lawyers practising in residential and commercial real estate.

Where Real Property Law and Government Programs Intersect
 
This panel features provincial representatives from key government departments whose work intersects with residential and commercial real estate practice. Speakers will provide practical overviews of their programs and highlight common regulatory considerations that arise in real property transactions. Topics will include environmental permitting and wetland requirements, the Closing Cost Support Program, and building and inspection services. The session will conclude with a moderated discussion and interactive Q&A focused on practical guidance for real property lawyers.

HST, Capital Gains, and When to Call an Accountant
 
A session with Rob MacGregor and Chris Arsenault (MRSB Group) on tax issues that frequently arise in real property matters, including:
     
  • HST implications for:
  • Short-term rentals
  • New housing construction
  • Capital gains considerations in real estate transactions
  • Identifying tax “red flags” and understanding when outside accounting advice is warranted.
The session will conclude with a Q&A, giving participants an opportunity to raise tax questions that may be encountered in practice.
 
Hot Topics on Closings: Practical Conveyancing Issues
 
A practitioner-led panel will examine common, and often challenging, issues that arise at closing, from a practical, problem-solving perspective, including issues such as:
 
  • Deficiency holdbacks
  • Well driller certificates and water testing
  • Mechanics’ lien
  • Other recurring closing-day issues and risk management considerations.
 This session will be moderated by Geoffrey Connolly, K.C., and will conclude with an interactive Q&A, allowing participants to raise questions and practical issues for discussion.

Price:
  • Non-CBA Member: $300.00 + HST = $345.00 per person
  • CBA Member: $240.00 + HST = $276.00 per person
Payment is due at time of registration and may be paid by e-Transfer to lawsociety@lspei.pe.ca or by cheque payable to the Law Society of PEI.
 
Registration Deadline: Monday, March 16, 2025
 
CLE Cancellation Policy: Registrants who cancel within two weeks but more than twenty-four (24) hours before the CLE will receive a fifty per cent (50%) refund and will be entitled to receive a copy of any CLE materials. Registrants who cancel within 24 hours of the CLE or who do not show will not be refunded any portion of the registration fee, but the registrant will be entitled to receive a copy of the CLE materials.
